1. Who We Are

This Privacy Policy explains how Innotent LTD ("Innotent", "we", "us", or "our") collects, uses, shares, and protects information when you use the App on iOS.

Innotent LTD is the data controller responsible for personal data processed through the App.

Innotent LTD
Yachin 4, Ramat Gan, Israel
Email: innotent.ltd@gmail.com

This Privacy Policy should be read together with our Terms of Use.

2. Summary

  • The App does not require an account, sign-in, or registration. We do not ask for your name, email address, or phone number.
  • When you use the identification feature, the photo you submit is sent over an encrypted connection to our servers and then to a third-party AI provider (OpenAI or Anthropic) solely to generate an identification result. We do not store your photos on our servers.
  • Your identification history and collection are stored locally on your device.
  • We use RevenueCat for purchases, subscriptions, advertising attribution, and pricing experiments, and Google Firebase for analytics and A/B testing.
  • We access your device's advertising identifier (IDFA) only if you grant permission through Apple's App Tracking Transparency prompt.
  • Payments are processed by Apple. We never receive your payment card details.
  • We do not sell your personal information.

3. Your Acknowledgment and Responsibility

By downloading, accessing, or using the App, you acknowledge that you have read and understood this Privacy Policy and our Terms of Use.

It is your responsibility to read this Privacy Policy and the Terms of Use before using the App or any of its features, including the identification feature, and to review them periodically for updates. If you do not agree with this Privacy Policy or the Terms of Use, do not download, access, or use the App.

Where applicable law requires your consent for a specific processing activity (for example, tracking through the advertising identifier), we will ask for that consent separately. Your use of the App does not replace that consent.

4. Information We Collect

4.1 Photos You Submit for Identification

The App's photo-based features, including stone identification, valuation, and authenticity check (together, the "identification feature"), let you take a photo with your camera or select a photo from your photo library. When you submit a photo:

  1. The photo is transmitted from your device to our servers, hosted on Google Cloud Platform in the United States, over an encrypted connection (HTTPS/TLS).
  2. Our servers forward the photo to a third-party AI service provider, OpenAI or Anthropic, which analyzes the image and returns an identification result.
  3. The result is sent back to your device.

We do not store your photos on our servers. Photos are processed only for the time needed to complete the identification request and are then discarded. We do not use your photos to train AI models, and we do not use them for any purpose other than providing the identification result.

Our AI service providers process submitted photos on our behalf to provide the identification result. Under the API terms that apply to our use of their services, these providers do not use data submitted through their APIs to train their models by default. They may retain submitted data for a limited period (typically up to 30 days) for purposes such as abuse and misuse monitoring and legal compliance, in accordance with their own terms and privacy policies, which we do not control.

The App only sends photos that you actively choose to submit for identification.

Please submit only photos of gems, rocks, crystals, minerals, or similar objects. Do not submit photos that include people (especially faces), documents, screens, license plates, or any other personal or sensitive information. If a photo you submit contains such information, it will be processed as part of the image. You are responsible for the content of the photos you choose to submit.

Photos can contain embedded metadata, such as location or device information. We do not use such metadata. You can turn off location tagging for your camera in your device settings.

When your device connects to our servers or to our service providers, technical information such as your IP address is necessarily processed to transmit the request and return the result. We do not use this information to identify you personally.

Identification and authentication results are generated automatically by AI, may be inaccurate or incomplete, and are provided for informational purposes only. They are not a professional gemological appraisal, certification, or valuation. See our Terms of Use for more information.

4.2 Information Stored and Processed on Your Device

Your identification history, saved items, collection, and the related photos and results are stored locally on your device. This information is not uploaded to our servers and we do not have access to it.

This information remains on your device until you delete it within the App or delete the App. If you use device backups (such as iCloud Backup), this data may be included in your backups, which are governed by Apple's terms and privacy policy.

The metal detector feature uses your device's magnetometer. Magnetometer readings are processed locally on your device and are not transmitted to our servers or stored by us.

4.3 Purchase and Subscription Information

All purchases and subscriptions are processed by Apple through the App Store. We do not receive or store your payment card details, billing address, or Apple Account credentials.

We use RevenueCat to manage in-app purchases and subscriptions. RevenueCat may process:

  • An anonymous App User ID generated for your installation of the App;
  • Purchase and subscription information, such as products purchased, transaction identifiers, subscription and trial status, renewal and cancellation dates, price, currency, and App Store country or storefront;
  • Device and app information, such as device model, operating system version, app version, language and region settings, and the identifier for vendor (IDFV);
  • IP address;
  • The advertising identifier (IDFA), only if you have granted tracking permission (see section 4.5);
  • Apple Search Ads attribution data (see section 4.5);
  • Your assignment to paywall, pricing, or offer experiments (A/B tests).

4.4 Analytics and A/B Testing

We use Google Firebase, including Google Analytics for Firebase, Firebase Remote Config, and Firebase A/B Testing, to understand how the App is used, measure performance, and test variations of features and screens. Firebase may collect:

  • App instance ID and Firebase installation ID;
  • Identifier for vendor (IDFV);
  • The advertising identifier (IDFA), only if you have granted tracking permission;
  • Usage data, such as screens viewed, features used, in-app events (for example, starting an identification or starting a subscription), session information, and first-open date;
  • Device information, such as device model, operating system version, app version, and language settings;
  • Approximate location (country, region, or city) derived from your IP address;
  • Your assignment to A/B test groups.

We do not send your photos to Firebase or RevenueCat.

4.5 Advertising Attribution and App Tracking Transparency

We promote the App using Apple Search Ads. To measure the effectiveness of our campaigns, the App uses Apple's AdServices framework to obtain an attribution token. This token is sent to RevenueCat to determine whether your installation came from an Apple Search Ads campaign and to obtain related campaign information (such as campaign, ad group, keyword, and country). This attribution does not require access to your advertising identifier.

The App may ask for your permission, through Apple's App Tracking Transparency (ATT) prompt, to access your device's advertising identifier (IDFA). If you allow tracking, the IDFA may be collected by RevenueCat and Firebase and used for advertising attribution and measuring campaign performance. If you do not allow tracking, the IDFA is not accessed.

You can change your choice at any time in your device settings: Settings > Privacy & Security > Tracking.

4.6 Device Permissions

  • Camera: used only to let you take photos for identification.
  • Photo Library: used only to let you select photos for identification and, where offered, to save images.
  • Tracking (ATT): used only as described in section 4.5.

The App requests each permission only when it is needed. You can change permissions at any time in your device settings. If you deny a permission, some features may not work.

4.7 Information You Provide When Contacting Us

If you contact us by email, we will process your email address, the content of your message, and any attachments you send, in order to respond to you.

4.8 Information We Do Not Collect

  • We do not collect your name, email address, or phone number, unless you contact us.
  • We do not request access to your device's precise location.
  • We do not access your contacts.
  • We do not receive your payment card details.
  • We do not store your photos on our servers.

5. How We Use Information

We use information to:

  • Provide the identification feature and return identification results;
  • Provide App features such as history and collection, which are stored on your device;
  • Process, validate, and manage purchases, subscriptions, free trials, and restoration of purchases;
  • Understand how the App is used, diagnose issues, and improve the App;
  • Run A/B tests on features, screens, paywalls, and pricing;
  • Measure the effectiveness of our advertising campaigns;
  • Detect and prevent fraud, abuse, and security incidents;
  • Respond to your requests and support inquiries;
  • Comply with legal obligations, enforce our Terms of Use, and protect our rights and the rights of others.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process personal data on the following legal bases:

  • Performance of a contract: to provide the identification feature and other App features you request, and to process and manage your purchases and subscriptions.
  • Legitimate interests: to analyze and improve the App, run A/B tests, measure Apple Search Ads campaigns without the advertising identifier, secure the App, and prevent fraud and abuse. We balance these interests against your rights and freedoms, and you may object to this processing (see section 14).
  • Consent: to access your advertising identifier through App Tracking Transparency, and for any other processing where consent is required by applicable law. You can withdraw your consent at any time without affecting the lawfulness of processing before withdrawal.
  • Legal obligation: to keep records required for accounting and tax purposes and to respond to lawful requests from public authorities.

7. Automated Processing

The identification feature uses automated AI processing to analyze images of objects. This processing does not make decisions that produce legal effects or similarly significant effects concerning you, within the meaning of Article 22 of the GDPR.

8. How We Share Information

We share information only as described in this Privacy Policy.

8.1 Service Providers

We use the following service providers, which process information on our behalf and in accordance with their agreements with us:

8.2 Apple

Apple processes payments, subscriptions, and Apple Search Ads attribution as an independent company under its own terms. Apple Privacy Policy

8.3 Other Disclosures

We may also disclose information:

  • If required by law, regulation, legal process, or a lawful request from a public authority;
  • To protect the rights, property, or safety of Innotent, our users, or others, and to detect or prevent fraud, abuse, or security issues;
  • In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case information may be transferred to the acquiring or successor entity;
  • With your consent or at your direction.

9. We Do Not Sell Your Personal Information

We do not sell your personal information, and we do not sell the photos you submit.

If you allow tracking through App Tracking Transparency, our use of your advertising identifier for advertising attribution and campaign measurement may be considered "sharing" for cross-context behavioral advertising or "targeted advertising" under certain U.S. state privacy laws. You can opt out at any time by denying or revoking tracking permission in Settings > Privacy & Security > Tracking, or by contacting us.

10. International Data Transfers

Innotent is based in Israel. The European Commission has recognized Israel as providing an adequate level of protection for personal data.

Our servers are hosted on Google Cloud Platform in the United States. Our service providers may process information in the United States and other countries whose data protection laws may differ from those in your country. When we transfer personal data from the EEA, the UK, or Switzerland to a country that has not been recognized as providing an adequate level of protection, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses (and the UK Addendum where applicable), the EU-U.S. Data Privacy Framework and its UK and Swiss extensions where the recipient is certified, or other lawful transfer mechanisms.

11. Data Retention

  • Photos submitted for identification: not stored on our servers; discarded after the identification request is completed. Our AI service providers may retain data for a limited period as described in section 4.1.
  • History and collection: stored only on your device until you delete them or delete the App.
  • Purchase and subscription records: retained for as long as needed to provide the App and as required for accounting, tax, and legal purposes.
  • Analytics and attribution data: retained according to the retention settings of Firebase and RevenueCat, and no longer than necessary for the purposes described in this Privacy Policy.
  • Support correspondence: retained for as long as needed to handle your request and for a reasonable period afterward for record-keeping, unless you ask us to delete it earlier.

We may retain information for longer where required by law or to establish, exercise, or defend legal claims.

12. Data Security

We use reasonable technical and organizational measures to protect information, including encrypted transmission (HTTPS/TLS) and restricted access to our systems. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your device secure.

13. Children's Privacy and Age Requirements

13.1 General

The App is intended for a general audience. The App's App Store age rating of 4+ reflects that the App does not contain objectionable content. It does not mean that the App is designed for or directed at children.

13.2 Age Requirement for the Identification Feature

Because the identification feature involves taking or selecting photos and transmitting them to our servers and to third-party AI service providers, you must be at least 18 years old to use the identification feature, or at least 13 years old with the permission and supervision of a parent or legal guardian. Children under 13 must not use the identification feature.

13.3 Parents and Guardians

Parents and legal guardians are responsible for supervising their children's use of devices and the App, for reviewing this Privacy Policy and the Terms of Use, and for deciding whether a child may use the identification feature.

13.4 Children Under 13

We do not knowingly collect personal information from children under 13, or under a higher age where required by applicable law. If you believe a child has provided us with personal information, for example by contacting us or by submitting a photo that contains personal information, please contact us and we will take appropriate steps to delete it.

14. Your Rights and Choices

Subject to applicable law, you have the right to:

  • Access your personal data;
  • Correct inaccurate personal data;
  • Request deletion of your personal data;
  • Restrict processing of your personal data;

14.4 Israel

Under the Israeli Protection of Privacy Law, 5741-1981, you may have the right to review personal information held about you and to request its correction or deletion. You may also contact the Israeli Privacy Protection Authority.

14.5 How to Exercise Your Rights

To exercise your rights, email us at innotent.ltd@gmail.com with the subject line "Privacy Request", and tell us your country (and state, if you are in the U.S.) and the right you wish to exercise.

Because the App does not use accounts, we generally cannot identify you or link data to you. To help us locate data related to you, you may provide information such as the order ID from your App Store purchase receipt. Please note that your history and collection are stored only on your device and your photos are not stored on our servers, so we may not hold such data to provide, correct, or delete.

We may need to verify your request before acting on it. We will respond within the time required by applicable law (for example, one month under the GDPR or 45 days under the California Consumer Privacy Act, which may be extended where permitted). If we deny your request, you may appeal by replying to our response with the subject line "Privacy Request Appeal".

15. Additional Disclosures for California Residents

In the preceding 12 months, we have collected the following categories of personal information, from your device and our service providers, for the purposes described in section 5:

  • Identifiers: App User ID, app instance and installation IDs, IDFV, IDFA (only with your permission), and IP address.
  • Commercial information: purchase and subscription history.
  • Internet or other electronic network activity: interactions with the App and usage events.
  • Geolocation data: approximate location derived from IP address (not precise location).
  • Audio, electronic, visual, or similar information: photos you submit for identification, processed temporarily and not stored on our servers.

We disclose these categories to the service providers listed in section 8 for business purposes. We do not sell personal information. We do not knowingly sell or share the personal information of consumers under 16 years of age. We do not use or disclose sensitive personal information for purposes that require offering a right to limit its use.

The App may contain links to third-party websites or services, such as Apple's subscription management pages. We are not responsible for the privacy practices of third parties. We encourage you to review their privacy policies.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will provide notice as required by applicable law, for example through a notice in the App.

Your continued use of the App after an updated Privacy Policy takes effect means you acknowledge the updated Privacy Policy. Where applicable law requires your consent to a change, we will ask for it.

18. Language

This Privacy Policy may be made available in other languages. If there is any inconsistency between the English version and a translated version, the English version prevails to the extent permitted by applicable law.
